INSTRUCTIONS TO PETITIONER FOR SERVICE OF COURT PAPERS-FAMILY COURT STATE OF NEW YORK

You have been given a summons or an Order to Show Cause and a copy of the petition, which directs the other party in this case to appear in this Court on the date indicated.

FOR ALL CASES:

1.     The papers MAY NOT be served on SUNDAY unless the petition contains a request for an Order of Protection.

2.     As a party in this case, YOU MAY NOT serve the papers upon the other person.

3.    The person who has delivered the papers MUST COMPLETE THE "AFFIDAVIT  OF SERVICE AND HAVE IT NOTARIZED. Be sure that a full physical description of the person to whom the  Summons and Petition were given is included OR the person who has served the court papers upon the Respondent may come to court with you on the adjourned date of the case.
